Oklahoma Divorce Laws - Jurisdictional Requirements


As Oklahoma family law attorneys, we thoroughly understand Oklahoma divorce laws and how they apply in different circumstances. One of the first legal requirements that must be met to begin the divorce process in Oklahoma is the state residency requirement. Under Oklahoma law, an action for divorce may only be maintained when:


  • At least one party has been a resident in good faith in the State of Oklahoma for at least six months immediately preceding the filing of the petition for dissolution of marriage.
  • At least one party has been a resident in good faith within the county where the action is filed for at least thirty days immediately preceding the filing of the petition for dissolution of marriage.
  • At least one party is an active member of the military who is stationed within the State of Oklahoma for at six months immediately preceding the filing of the petition for dissolution of marriage.
  • If there are children whose custody and support are at issue in a divorce or parentage action, there are a number of complex laws which govern jurisdiction, including the Uniform Interstate Family Support Act, the Uniform Child Custody Jurisdiction and Enforcement Act, and the Indian Child Welfare Act.

Divorce Law in Oklahoma - Fault vs. No-Fault Divorce


Oklahoma is a no-fault divorce state, meaning that the relative fault of the parties in the dissolution of marriage does not affect the outcome of the case. Oklahoma has retained its fault-based grounds, including adultery, insanity, physical cruelty, and abandonment, but the overwhelming majority of dissolution cases are granted on the basis of irreconcilable incompatibility.  Oklahoma’s no fault provisions allow divorces to be granted without proof of fault, which permits matters to be resolved without putting the parties or their children through the often needless embarrassment of proving fault-based grounds.
